DISTRIBUTOR AGREEMENT - TERMS AND CONDITIONS |
|
I hereby apply to become an independent distributor of INTERLINK NETWORK SDN BHD. As an independent distributor, I understand and agree that:
I am 18 years old when I enter this agreement.
Upon acceptance of this application by INTERLINK NETWORK SDN BHD, I shall hereby become an independent distributor responsible for my own business and not an employee of the company. As an independent distributor, I shall adhere to any laws covering such status.
I have carefully reviewed the INTERLINK NETWORK SDN BHD Marketing Plan and Statement of Policy and acknowledge that they are incorporated as part of this agreement in their present form and as modified from time to time by INTERLINK NETWORK SDN BHD.
I agree to purchase the products from appropriate source so as not to distort or manipulate the Marketing Plan.
I shall declare my income derived from INTERLINK NETWORK SDN BHD to the Inland Revenue department.
I release and save harmless the Company from and against all liabilities whatsoever which may result from any action or commission as an independent distributor.
I agree to limit my use of promotional materials to those which are made available for distributor use by the company.
I shall not make use of any trade marks or trade names owned by the company other than official released materials provided for distributor use.
I agree to and accept the company’s policy which prohibits the purchase of products or services in unreasonable amounts solely for the purpose of qualifying for advancement in the Marketing Plan.
The acceptance of this agreement does not constitute the sale of franchise or territory and no fees have been paid or will be charged for the right to distribute the company’s products pursuant to this agreement. This agreement is not intended and shall not be construed to create a relationship of employer-employee, agency, joint-venture or partnership between the Distributor, Sponsor or the company.
In order to maintain a viable marketing system and to comply with changes in applicable law, the company reserves the right to change prices, policy, literature and/or Marketing Plan with written notice to me and I shall abide by such new changes.
INTERLINK NETWORK SDN BHD reserves the right to terminate any distributor who directly or indirectly spreads or cause to spread any rumors, remarks, articles, literature and/or subject them to public ridicule, contempt or odium. Such termination shall be without compensation of any kind to the Distributor but prejudice to the Company’s right to institute whatever legal proceedings deemed necessary for the recovery of any sum or prestige loss and/or goodwill suffered by INTERLINK NETWORK SDN BHD.
I shall not resell INTERLINK NETWORK SDN BHD products lower than the selling price fixed by the company.
If I decide not to continue as an INTERLINK NETWORK SDN BHD Distributor, I may submit my resignation any time verbally or for any reason, giving 30 days written notice to the company. I may keep my starter kit but shall not be entitled to any refund whats ever.
Any person who for whatsoever reason(s) ceases to be an INTERLINK NETWORK SDN BHD Distributor, shall not be re-admitted before the lapse of a minimum period of six (6) calendar months from the datse of his/her termination. The company reserves the right to reject any application without giving any reason whatsoever.
This agreement constitute the entire agreement between the Distributor and INTERLINK NETWORK SDN BHD and no other promises, representations, guarantees or agreements of any kind shall be brought to the appropriate court of law of the country.
I acknowledge that I have read and understood and agree to the terms and conditions set forth in this agreement.
